Once the online purchase procedure is completed, the Customer is required to print and keep these General Conditions of Sale and the related order form, already viewed and accepted.
1. OBJECT
1.1 These General Conditions of Sale relate to the sale of products made online through the e-commerce service on the website www.2hbdanceshoes.com (hereafter also referred to as the "Site").
1.2 The products sold on the site can be purchased and delivered in Italy, in the countries of the European Union and in non-European countries
2. SUBJECTS
2.1 The products are sold directly by the company Operapelle SRL with registered office in Italy, in Via E. 2.2 These General Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for products on www.2hbdanceshoes.com and do not regulate, on the other hand, the supply of services or possibly the sale of products by of subjects other than 2HB Dance Shoes that are present on the Site through links, banners or other hypertext links. Before submitting orders and purchasing products and services from subjects other than the Seller, we suggest checking their conditions of sale, because 2HB Dance Shoes is not responsible for the provision of services by third parties other than the Seller.
2.3 The products are sold to the Customer identified by the data entered when completing and sending the Order Form in electronic format with simultaneous acceptance of these General Conditions of Sale.
2.4 The products on the Site are aimed at adult customers. By placing an order through this Site, the Customer declares to have completed 18 (eighteen) years and to possess the legal capacity to enter into binding contracts.

3. SALE THROUGH ELECTRONIC COMMERCE SERVICE
3.1 By online sales contract is meant the distance contract concerning the sale of movable goods (hereinafter Products) stipulated between the Customer and the company 2HB Dance Shoes with the site www.2hbdanceshoes.com -, as part of a e-commerce service organized by 2HB Dance Shoes which, for this purpose, uses remote communication technology called the Internet.
3.2 To conclude the purchase contract for one or more Products, it is necessary to fill out the Order Form in electronic format (hereafter "Order") and transmit it to the Seller through the Internet following the relative instructions.
3.3 The Order contains:

the payment methods available to the customer;
the methods of delivery of the products and the relative shipping costs;
3.4 The photographic representation of the products on the Site has the sole purpose of presenting them to the Customer for sale, without any guarantee or commitment by the Seller regarding the exact correspondence of the image depicted on the Site with the real product; and this, with particular regard to its actual dimensions, accessories and / or the chromatic aspects of the products and / or packaging.
3.5 Before concluding the contract, the Customer will be asked to confirm the reading of the General Conditions of Sale including the information on the right of withdrawal and the processing of personal data.
3.6 The contract is concluded when 2HB Dance Shoes receives the Order Form through the Internet, after verifying the correctness of the data relating to the order itself.
3.7 The language available to conclude the contract with 2HB Dance Shoes is Italian and the applicable law is Italian.
3.8 Once the contract is concluded, 2HB Dance Shoes will take charge of the Order for its fulfillment.
4. PROCESSING THE ORDER
4.1 By submitting the Order via the Internet, the Customer accepts and undertakes to observe these General Conditions of Sale in relations with 2HB Dance Shoes.
4.2 Once the contract is concluded, 2HB Dance Shoes will send an Order Confirmation by email, containing a summary of the information already contained in the Order described in paragraphs 3.3, 3.4 and 3.5.
4.3 Before sending the Order Confirmation, the possibility remains for 2HB Dance Shoes to request additional information from the Customer in reference to the Order sent. If the Customer fails to provide the Seller with the additional information requested, the same reserves the right not to accept the order sent.
4.4 2HB Dance Shoes may not process orders which do not give sufficient guarantees of solvency or which are incomplete or incorrect or in the event of unavailability of products. In these cases, it will inform the Customer, by e-mail, that the contract is not concluded and that 2HB Dance Shoes has not followed up on the Order specifying the reasons. In this case, the sum charged to the customer will be refunded by bank transfer.
4.5 If the products presented on the website are no longer available or on sale after sending the Order, 2HB Dance Shoes will promptly communicate the possible unavailability of the Products ordered. In this case, the sum charged to the customer will be refunded by bank transfer to the current account indicated by the customer.
4.6 Each sale made by 2HB Dance Shoes through the online sales service may concern one or more products, with no quantity limit for each item.
4.7 2HB Dance Shoes reserves the right to refuse orders from a customer with whom there is an ongoing legal dispute relating to a previous order. This also applies to all cases in which 2HB Dance Shoes deems the Customer unsuitable, including, by way of example, the case of previous violations of contract conditions for online purchase on the Site or for any other legitimate reason, especially if the customer has been involved in fraudulent activities of any kind.
5. SALE PRICES
5.1 Unless otherwise indicated in writing, all Product prices and shipping and delivery costs indicated on the Site and in the Order are to be considered VAT included and expressed in Euros. The validity of the prices indicated is always and only that indicated by the Site at the time of transmission of the Order through the Internet. The prices of the Products and the shipping and delivery costs may vary without notice. The Customer is required to ascertain the final sale price before submitting the relevant Order.
5.2 All Products are shipped directly from Italy. The prices of the Products and the shipping and delivery costs indicated on the Site and in the Order, unless otherwise specified, are to be considered not inclusive of any costs related to customs duties and related taxes if the shipment takes place in non-EU countries or in countries where current legislation provides for import charges.
5.3 These costs are therefore charged to the Customer and must be paid directly upon delivery of the Products
6. PAYMENT METHODS
Each payment by the Customer can only be made in one of the ways indicated in the Order Form and which are summarized in the following articles.
6.1 Credit cards and prepaid cards.
6.1.1 2HB Dance Shoes accepts payments made with the following credit cards and prepaid cards: Visa, Mastercard, Maestro, without applying any additional charge on the price of the product or shipping. It is understood that the customer must have a valid credit card at the time of purchase and that the name on the credit card must be the same as indicated on the billing information. Without these conditions, it will not be possible to proceed with the order and the consequent purchase of the selected product.
6.1.2 At the time of online purchase, at the same time as the Order Confirmation, the reference banking institution will charge the amount relating to the order on the Customer's credit card.
6.1.3 Once the order has been processed (therefore after having instructed the Courier for the shipment), if the Customer intends to exercise the Right of Withdrawal, 2HB Dance Shoes will instruct the reference banking institution to credit the amount to be refunded by bank transfer to the bank account indicated by the customer.
6.2 Paypal.
6.2.1 If the Customer has a Paypal account (achievable from the www.paypal.com website), 2HB Dance Shoes provides him with the possibility to make all payments using directly the credentials for accessing the www.paypal.com website.
6.3 Bank transfer
6.3.1 2HB Dance Shoes accepts payments made by bank transfer to be paid to the IBAN coordinates IT04P0331713401000010303788 addressed to 2HB Dance Shoes and indicated in the order confirmation email. The reason to be reported in the payment made by bank transfer must indicate the following wording "PAYMENT ORDER ESHOP + order number" as better specified in the confirmation email.
6.3.2 Payment must be made by the Customers no later than 7 days from the date of receipt of the order confirmation e-mail. After this deadline to make the payment, 2HB Dance Shoes will be authorized to cancel the order sent by the Customer.
6.3.3 In any case, the shipment of the products will take place exclusively following the correct crediting of the entire agreed amount.
7. SHIPMENTS AND DELIVERY OF THE PRODUCTS
7.1 Each shipment contains:
the / the products / or ordered / or;
the relative transport document / accompanying invoice;
any information and marketing material.
7.2 The delivery of the Products purchased through the Site is carried out at the customer's home.
7.3 Delivery to the Customer's home
7.3.1 The purchased products will be delivered by the courier identified by 2HB Dance Shoes to the shipping address indicated by the Customer on the Order.
7.3.2 Unless explicitly stated otherwise, delivery is meant at street level. Upon receipt of the goods at the address indicated during the purchase phases, the Customer is required to check:
the integrity of the delivered packages, packaging and sealing materials;
correspondence of the number of packages delivered to what is indicated in the transport document.
In case of anomalies, the Customer must immediately contest them by affixing the wording "Accepted with reserve" on the delivery receipt of the courier. Otherwise the possibility of raising any dispute will lapse.
8. RIGHT OF WITHDRAWAL
8.1 Pursuant to art. 52 and following of the Consumer Code (Legislative Decree no. 206/2005 and subsequent amendments) the Consumer Customer (meaning by this definition the one provided by art. 3 Consumer Code, or "any natural person who acts on the site for extraneous purposes to any business or professional activity that may be carried out "), has the right to withdraw from the contract concluded with 2HB Dance Shoes, without any penalty, for any reason and without the need to provide any explanation, within the term of 14 (fourteen) working days, from the day of receipt of the products purchased on the Site.
8.2. For the purposes of exercising the right of withdrawal, the Customer must, before the expiry of the term referred to in the previous point, inform 2HB Dance Shoes of his decision by sending written communication to the following address:

within 14 days of receipt of the products. This communication can also be sent by e-mail to the e-mail address info@2hb.it.
8.3. In case of exercise of the right of withdrawal, the Customer is required to return the goods received to 2HB Dance Shoes, by sending it to the 2HB Dance Shoes in Corridonia (MC), Via E. Mattei, 110, without undue delay and in any case within the fourteen days following the date on which he communicated his decision to withdraw from the contract; the deadline is considered respected if the Customer sends back the goods before the expiry of the fourteen-day period.
8.4. The direct cost of returning the goods is charged to the customer.
8.5. The Customer is required to return the goods in an intact state of conservation and with original labels not removed. The packaging of the products must be accurate, in order to safeguard the original wrapping from damage, writing or labels. The consumer is responsible for the decrease in the value of the goods resulting from a manipulation of the goods other than that necessary to establish the nature, characteristics and functioning of the same.
8.6. If the right of withdrawal has been exercised in accordance with the aforementioned provisions, 2HB Dance Shoes will return all payments received to the Customer within thirty days of receiving the withdrawal notice, in relation to the order to which the withdrawal refers, using the same means of payment used by the Customer for the initial transaction if this does not entail the Customer costs resulting from the refund; however, pursuant to art. 56, paragraph III, Legislative Decree no. 21/2014, 2HB Dance Shoes has the right to withhold the refund until it has received the goods or until the Customer has shown that he has sent the goods back, whichever occurs first.
8.7. The right of withdrawal is the faculty of only natural persons who act for purposes unrelated to any business, commercial, craft or professional activity carried out (consumers). Therefore, among other things, resellers and companies are excluded from the right of withdrawal.
8.8. The right of withdrawal is also excluded, pursuant to art. 59 Legislative Decree no. 21/2014, in the case of the supply of personalized goods (see previous art.2.6.), As well as sealed goods that do not lend themselves to be returned for reasons of hygiene or connected to the protection of health and which have been opened after delivery.
8.9. Refunds or replacements are not made on customized products at the express request of the customer (e.g. customized products with names and / or numbers, with patches, with initials, except for defective or damaged products); on underwear and costumes; on match shirts following the change of the player's jersey number or his transfer to another team. For discounted products (Outlet section, special promotions) no refunds are made but replacements or the request for a voucher of a value corresponding to the amount paid can be used, to be used later.
9. WARRANTY OF THE NON-CONFORMING PRODUCT
9.1 2HB Dance Shoes is responsible for any defect in the products offered on the site, including the non-compliance of the items with the products ordered, in accordance with the provisions of Italian law.
9.2 If the Customer has entered into the contract as a Consumer (by this definition any natural person acting on the site for purposes unrelated to any business or professional activity carried out), this warranty is valid provided that the conditions of indicated below:
a) the defect occurs within the timeframe provided for by current legislation;
b) the Customer submits a formal complaint relating to the defects within a maximum of 2 months from the date on which the defect was found by the latter;
9.3 In the event that the Customer detects a lack of conformity of the product, and is a consumer, the same has the right to request its repair or replacement at no cost, where possible and not excessively expensive, and if these are not possible or would result excessively burdensome, may request a reasonable price reduction or contract termination. The termination of the contract is however excluded in case of minor conformity defects.
9.3 Following the complaint, 2HB Dance Shoes will, within a reasonable period, collect the product from the Customer and, after verifying the existence of the discrepancy, replace it or, if the conditions are met, partially or fully refund the price; however, 2HB Dance Shoes has the right to propose alternative remedies available, such as, for example, replacing the product with another of a different nature but equivalent value, chosen from those shown on the site, or issuing a voucher of value corresponding to the amount paid, to be used later by contacting Customer Service; in the event that the Customer accepts, 2HB Dance Shoes will carry out the specifically proposed remedial service.

11. COMMUNICATIONS TO THE CUSTOMER

14. APPLICABLE LAW, DISPUTE RESOLUTION AND JURISDICTION
14.1 These General Conditions of Sale are governed by Italian law and will be interpreted on the basis of it, without prejudice to any other prevailing mandatory rule of the country of habitual residence of the Customer. Consequently, the interpretation, execution and termination of the General Conditions of Sale are subject exclusively to Italian law and any disputes inherent and / or consequent to them must be resolved exclusively by the Italian judicial authority. In particular, if the Customer holds the status of Consumer, any disputes must be resolved by the court of the place of domicile or residence of the same according to the applicable law or, at the choice of the consumer in case of action taken by the consumer himself, by the Court of Ascoli Piceno. If the Customer instead acts in the exercise of his business, commercial, craft or professional activity, the parties consensually establish the exclusive jurisdiction of the Court of Ascoli Piceno.
15. MODIFICATION AND UPDATE
2HB Dance Shoes can make changes or amendments to these General Conditions of Sale at any time. Therefore, the Customer will be asked to accept only the General Conditions of Sale in force at the time of the relative purchase. The new General Conditions of Sale will be effective from the date of publication on the website www.2hbdanceshoes.com and in relation to purchase orders submitted after that date.
